Tuliba Clusiana will make commercially reasonable efforts to accommodate requested delivery preferences whenever operationally feasible.

9. Partial Deliveries

Where operationally necessary, Tuliba Clusiana reserves the right to complete an Order through one or more partial deliveries.
Unless otherwise agreed, partial deliveries shall not entitle the Customer to cancel the remaining portion of the Order or refuse Products already delivered.
The Customer shall only be required to pay the total Order amount agreed at the time of purchase and shall not incur additional delivery charges solely because Tuliba Clusiana elects to complete an Order through separate deliveries, unless otherwise agreed in advance.

11. Recipient Availability

The Customer is responsible for ensuring that the intended Recipient, or another individual reasonably authorized to receive the Order on the Recipient’s behalf, is available during the anticipated delivery period.
Where the intended Recipient is unavailable, Tuliba Clusiana or its Delivery Partner may, acting reasonably, deliver the Order to:
Another adult reasonably believed to be authorized to receive the Order;
A receptionist;
A concierge;
Building management;
Security personnel; or
Any other individual reasonably appearing to be authorized to accept delivery at the designated address.
Delivery completed under these circumstances shall be deemed a successful delivery, provided that the Delivery Partner acted reasonably and in good faith, unless credible evidence establishes otherwise.

12.Failed Delivery Attempts

A delivery attempt may be considered unsuccessful where:
The delivery address is incorrect or incomplete;
The Recipient cannot be contacted;
No authorized person is available to receive the Order;
Access to the delivery location is denied;
The Recipient refuses delivery without a valid reason attributable to Tuliba Clusiana; or
Other circumstances attributable to the Customer or Recipient prevent successful delivery.
Where operationally feasible, Tuliba Clusiana may attempt to contact the Customer or arrange an additional delivery attempt.
Additional delivery charges may apply for each subsequent delivery attempt.
Tuliba Clusiana shall not be responsible for deterioration, damage, or reduced freshness of perishable Products resulting from unsuccessful delivery attempts caused by the Customer or Recipient.

14.Delivery Delays

Although Tuliba Clusiana strives to complete deliveries within the estimated timeframe, delays may occasionally occur.
Delivery delays may result from circumstances including:
Heavy traffic;
Severe weather;
Public holidays;
Peak seasonal demand;
Courier delays;
Supply chain interruptions;
Government restrictions;
Technical failures;
Unexpected operational issues; or
Force Majeure events.
Reasonable delivery delays shall not constitute a breach of this Shipping & Delivery Policy.
Where reasonably practicable, Customers will be informed of significant delays.

16.No Exact Delivery Time

Unless expressly confirmed in writing by Tuliba Clusiana, the Company does not guarantee delivery at a specific hour or minute.
Requested delivery times are treated as preferences only and remain subject to:

Operational requirements;
Weather conditions;
Delivery volume; and
Other circumstances beyond our reasonable control.

18.Deliveries to Hotels, Hospitals, Universities & Controlled-Access Premises

Deliveries to hotels, hospitals, universities, business centers, government buildings, residential compounds, and other controlled-access premises remain subject to the policies, security procedures, and access requirements of such locations.
Tuliba Clusiana shall not be responsible for delays resulting from security procedures, access restrictions, visitor policies, or the inability to gain entry after reasonable efforts have been made.

20.Quality Complaints

Complaints relating to freshness or quality should be submitted as soon as reasonably practicable after delivery, together with supporting photographs where reasonably requested, to enable Tuliba Clusiana to conduct a fair and objective assessment.

21.Product Substitutions

Tuliba Clusiana is committed to delivering Products that closely reflect the style, quality, value, and overall presentation displayed on the Website.
However, due to the seasonal and perishable nature of flowers and certain decorative materials, substitutions may occasionally become necessary.
Substitutions may occur where specific flowers, foliage, wrapping materials, ribbons, containers, decorative accessories, or similar components are unavailable or unsuitable at the time of preparation.
Whenever substitutions are necessary, Tuliba Clusiana will make commercially reasonable efforts to ensure that any replacement:
Maintains the overall design and artistic style of the original Product;
Preserves the overall aesthetic presentation;
Is of comparable or higher quality;
Is of comparable or greater material value; and
Does not materially alter the intended appearance or purpose of the Product.
Substitutions shall never intentionally reduce the overall quality or material value of the Product.
Where practicable, substitutions will also preserve the original Product’s color palette, luxury appearance, overall floral composition, and visual style.
Where a proposed substitution would materially change the essential nature, primary design, or overall value of the Product, Tuliba Clusiana will, where reasonably practicable, attempt to contact the Customer before completing the Order.

23.International Delivery

Corporate, wedding, hospitality, and event Orders often involve additional planning and coordination.
Customers are responsible for ensuring:
Accurate venue information;
Authorized access arrangements;
Appropriate unloading facilities where necessary;
Availability of venue representatives; and
Compliance with venue-specific delivery procedures.
Tuliba Clusiana shall not be responsible for delays arising from venue access restrictions, security procedures, event scheduling changes, or failures by venue representatives to receive the Products.
Where separate written agreements exist for corporate, hospitality, wedding, or event services, those agreements shall prevail over this Policy to the extent of any inconsistency.

26.Proof of Delivery

For quality assurance, operational efficiency, fraud prevention, and dispute resolution, Tuliba Clusiana may obtain and retain reasonable proof that delivery has been successfully completed.
Proof of Delivery may include, without limitation:
Recipient signature;
One-Time Password (OTP) confirmation;
Electronic acknowledgment;
GPS delivery confirmation;
Delivery timestamp;
Courier delivery records;
Delivery application records;
Delivery photographs; or
Any other commercially reasonable delivery verification method.
Where operationally appropriate, delivery photographs may be taken solely for:
Delivery verification;
Quality assurance;
Fraud prevention;
Customer support;
Operational purposes; and
Dispute resolution.
Any delivery photographs shall be handled in accordance with the Tuliba Clusiana Privacy Policy and shall not be used for unrelated commercial purposes without an appropriate legal basis.

However, Tuliba Clusiana cannot guarantee that the Recipient will not independently determine, infer, or otherwise discover the identity of the sender through circumstances beyond the Company’s reasonable control.
Accordingly, Tuliba Clusiana shall not be responsible for any consequences arising from the Recipient identifying the sender through means unrelated to any fault of the Company.

Floor Number;
Landmark;
Access Instructions;
Gate Codes (where applicable); and

Failure to provide accurate information may result in:
Delivery delays;
Failed delivery attempts;
Additional delivery charges;

Inability to complete delivery.
The Customer shall be responsible for any additional costs arising from inaccurate or incomplete delivery information.

13.Customer Contact Responsibility

The Customer is responsible for ensuring that the contact information provided during the ordering process is accurate, complete, and accessible throughout the delivery process.
The Customer and, where applicable, the Recipient should make reasonable efforts to remain available using the telephone number provided with the Order until delivery has been completed.
If Tuliba Clusiana or its Delivery Partner is unable to contact the Customer or Recipient using the information provided, the Company may, where appropriate:
Delay the delivery;
Reschedule the delivery;
Return the Order to our facilities; or
Cancel the delivery where completion is no longer reasonably possible.
Any additional delivery costs resulting from incorrect contact information or the Customer’s failure to respond may be charged to the Customer.

15. Delivery Address Changes

Customers may request changes to the delivery address before the Order enters the delivery stage.
Once an Order has been prepared, assigned to a Delivery Partner, or dispatched, Tuliba Clusiana cannot guarantee that a requested address change can be accommodated.
Where an address change is operationally possible, additional delivery charges may apply if the new destination increases delivery distance, delivery time, or operational costs.
Tuliba Clusiana reserves the right to decline address change requests that cannot reasonably be fulfilled.

17. Recipient Refusal

If the Recipient refuses to accept an Order for reasons not attributable to:
Delivery of the wrong Product;
Material damage occurring prior to delivery;
Significant manufacturing or preparation defects; or
Errors directly caused by Tuliba Clusiana,
the Order shall be considered successfully fulfilled for delivery purposes.
Due to the perishable nature of many Products offered by Tuliba Clusiana, including fresh flowers and floral arrangements, refunds, replacements, or credits may not be available in such circumstances except where required by applicable law or expressly provided under the Refund & Return Policy.

19. Delivery Restrictions

Tuliba Clusiana reserves the right to decline, postpone, suspend, or cancel delivery where delivery cannot reasonably or safely be completed.
Such circumstances may include, without limitation:

Civil unrest;
Natural disasters;

Building access restrictions;
Failure to obtain entry authorization;

Tuliba Clusiana shall not require its employees or Delivery Partners to complete deliveries where doing so would expose them to unreasonable safety or security risks.
Where reasonably practicable, the Customer will be notified and alternative delivery arrangements may be discussed.

22.High-Demand Periods

Certain occasions generate exceptionally high order volumes, including but not limited to:
Valentine’s Day;
Mother’s Day;
Eid holidays;
Christmas;
New Year’s celebrations; and
Other seasonal events.
During such periods:
Delivery windows may be broader than usual;
Exact delivery times may not be available;
Preparation times may increase;
Delivery routes may be adjusted according to operational requirements; and
Certain premium delivery services may be temporarily unavailable.
Tuliba Clusiana will continue to use commercially reasonable efforts to deliver Orders as close as possible to the requested delivery timeframe.

24.Customer Delay During Delivery

Customers and Recipients are expected to cooperate with the delivery process and make reasonable efforts to receive their Orders promptly.
Delivery personnel are not required to wait for extended periods at the delivery location.
If delivery cannot reasonably be completed because of delays caused by the Customer or Recipient, including repeated requests to wait beyond a reasonable period, the delivery may be treated as an unsuccessful delivery attempt.
Any additional delivery attempt may be subject to additional delivery charges.

25.Fresh Flowers & Perishable Products

Many Products offered by Tuliba Clusiana consist of fresh flowers and other naturally perishable materials.
Customers acknowledge that fresh flowers are living natural products that continue to develop after harvesting and may naturally vary in:
Bloom stage;
Size;
Shape;
Color tone;
Fragrance;
Texture;
Foliage;
Seasonal availability; and
Overall appearance.
Accordingly, Products delivered on different dates may naturally differ in appearance, even where the same Product has been ordered.
These natural characteristics are an inherent feature of fresh floral products and shall not, by themselves, be considered defects.
The expected lifespan of fresh flowers varies depending on the flower variety, environmental conditions, transportation conditions, storage conditions, and post-delivery care. Accordingly, Tuliba Clusiana does not guarantee the longevity or vase life of fresh flowers after successful delivery.
To preserve freshness and product quality, Customers and Recipients should follow any care instructions supplied by Tuliba Clusiana.
Tuliba Clusiana cannot guarantee the condition, freshness, or longevity of perishable Products after successful delivery has been completed, particularly where Products are exposed to unsuitable environmental conditions, mishandling, neglect, improper storage, or circumstances beyond our reasonable control.

28.Customized & Personalized Orders

Customized, personalized, bespoke, or made-to-order Products are individually prepared according to the Customer’s specific instructions.
Accordingly:
Production may require additional preparation time;
Certain design requests remain subject to material availability;
Minor artistic variations may naturally occur; and
Exact duplication of reference images, sketches, or inspiration photographs cannot be guaranteed.
Unless otherwise required by applicable law or expressly agreed in writing, customized or personalized Products are generally not eligible for cancellation, return, exchange, or refund once production has commenced.

30.Risk and Ownership

Risk of loss or damage to the Product shall transfer to the Customer upon successful delivery to:
The Customer;
The intended Recipient; or
Any person reasonably believed to be authorized to receive the Order on the Recipient’s behalf.
Ownership of the Product shall transfer only after Tuliba Clusiana has received full payment for the Order, unless otherwise required by applicable law.
Following successful delivery, Tuliba Clusiana shall not be responsible for deterioration, loss, theft, damage, or reduced freshness resulting from:

Improper storage;
Environmental conditions;
Neglect;
